Welcome to tmgarage.fyi (hereafter referred to as "the Website"). This Website is owned and operated by TM Garage. By accessing our site, browsing our workshop content, or purchasing our digital metalworking plans (hereafter referred to as "the Plans"), you agree to be legally bound by the following Terms and Conditions.
If you do not agree to all of these terms, please do not use this Website or purchase our digital files.
1. Eligibility and Website Use
By using this Website, you represent that you are at least 18 years of age or the age of majority in your jurisdiction, and possess the legal capacity to enter into a binding agreement. You agree to use the Website strictly for lawful purposes and in a manner that does not infringe upon or restrict anyone else's use of the site.
2. Digital Product Delivery and Account Access
- Ecwid Storefront: All digital transactions and orders are processed securely via our e-commerce partner, Ecwid.
- Instant Delivery: Upon successful payment processing, our system automatically generates and emails secure download links to the address you provided at checkout.
- Link Security Limits: To prevent unauthorized redistribution, download links are strictly limited to 3 access attempts and automatically expire 72 hours after purchase. You are solely responsible for downloading and archiving the PDF or blueprint files to your personal storage device before link expiration.
3. Intellectual Property and Royalty-Free License
All Plans, blueprints, schematics, designs, text, graphics, and code on this Website are the exclusive intellectual property of TM Garage and are protected by copyright laws.
When you purchase a plan, TM Garage grants you a non-exclusive, non-transferable, royalty-free license under the following strict conditions:
- Permitted Use: You may use the Plans to construct physical items for personal use, or build physical items for commercial sale. No ongoing royalties are owed to TM Garage for physical items sold.
- Prohibited Use: You are strictly prohibited from reselling, sub-licensing, sharing, renting, copying, uploading to public drives, or redistributing the digital Plan files, drawings, or blueprints themselves, in whole or in part.
4. Refund and Cancellation Policy
Due to the non-tangible, digital nature of our goods, all sales are final. Once a download link has been issued or accessed, we do not offer refunds, order cancellations, or exchanges under any circumstances.
In accordance with our standalone Refund Policy, exceptions are made solely for verified duplicate purchases within 24 hours or unfixable, corrupted file transfers. Fraudulent chargeback filings will be aggressively disputed using automated delivery tracking logs.
5. Liability, Safety, and Engineering Disclaimer
- Informational Purpose Only: The Plans represent custom fabrication concepts and are not certified engineering blueprints.
- Assumption of Risk: Metalworking involves welding, grinding, and machining machinery which carry high risks of personal injury, permanent disability, death, and property damage. By purchasing our Plans, you voluntarily assume all risks associated with fabricating the designs.
- Hold Harmless: To the maximum extent permitted by law, TM Garage, its owners, and affiliates shall not be liable for any direct, indirect, incidental, or consequential damages, injuries, tool failures, structural collapses, or financial losses resulting from the use, misuse, or assembly of the Plans. You agree to indemnify and hold TM Garage harmless against all third-party legal claims.
6. Payment and Billing Security
All payments are handled by certified, third-party payment gateways (e.g., Stripe, PayPal) integrated through Ecwid. TM Garage does not view or store your credit or debit card data. You agree to provide accurate, current purchase and account information for all checkout transactions.
7. Governing Law and Dispute Resolution
These Terms and Conditions and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws governing the business domicile of TM Garage. Any legal dispute, claim, or controversy arising out of your use of this Website or the purchase of our Plans shall be resolved through binding, private arbitration rather than a public court trial.
8. Changes to Terms
We reserve the right to update, change, or replace any part of these Terms and Conditions at any time. Any revisions will be marked by an updated "Last Updated" date at the top of this document. Your continued use of the Website following changes constitutes absolute acceptance of those modifications.
